Claim

MP's notion of institution (1954–55) is best read not as a development of Husserl's Stiftung but as a paradigm shift from the constituting subject (Husserlian-Cartesian, transcendental ego) to the instituting subject. The instituting subject "is not a subject for whom sociality is experientially given, but rather a subject in whom sociality operates" (León's formulation); it cannot be inherently individuated independently of an institutional background, and the instituted "is not the immediate reflection of the activity of the former and can be taken up by himself or by others without a total recreation being at issue" (I&P 76). Institution and constitution are almost opposites — not gradations but near-antagonists, since institution is independent of the maintainer's adhesion while constitution is contemporaneous with conscious activity. Across four chapters in Mendoza-Canales 2026 (León, Pagan, Mendoza-Canales, Popa) the paradigm-shift reading converges from intersubjectivity, history, ontology, and sense-formation respectively.

Counterpressure / Limits

  • Cross-chapter convergence within one volume. As with claims#institution-as-middle-term-1953-55 and claims#revolution-and-institution-share-mise-en-question, the four-chapter convergence in Mendoza-Canales 2026 is partly editorial. A reader sympathetic to the Husserlian-enrichment reading (Caminada's "common mind" project, or the broader Husserlian phenomenology of intersubjectivity) could argue that "instituting subject" is a productive enrichment rather than a paradigm shift.
  • Tension with claims#ip-pop-architectural-hierarchy (now supported, this run). The architectural-hierarchy claim treats Stiftung as the German register of institution, both retained from Husserl. The paradigm-shift claim is stronger: institution is not just a translation but a near-antagonist of constitution. The two claims are coordinate but not identical: the architectural-hierarchy claim is about what the late MP retains from Husserl (the Stiftung mechanism); the paradigm-shift claim is about what the late MP rejects from Husserl (the constituting subject). Both are defensible; together they specify MP's ambivalent inheritance of Husserl.
  • Larison Ch 11 reading (extraction-note Pass 2a Argument 5) complicates the paradigm-shift framing: Larison reads MP's "institution" as French-social-thought + Husserlian Stiftung synthesis, with Durkheim-Mauss-Hauriou supplying the supra-individual register. On Larison's reading, the paradigm-shift is also a synthesis, not just a rejection. The Larison-side reading is captured at claims#mp-institution-as-stiftung-meets-french-social-thought (candidate, this run) — both readings coexist within Mendoza-Canales 2026.
  • C3 supported-jury refuter objection (evidence-chain lens, consolidation 2026-07-27 run 5, wf_a0b34b6a-bc5): Evidence bullet 3 (Mendoza-Canales, Ch 4 §1) failed the anchor test three ways, and one of the three makes the anchor tell against the claim's headline. (a) The quotation was not the source's. The bullet presented, in quotation marks, "not a mere terminological adjustment but a transformation of phenomenology into a 'materialist ontology' that displaces transcendental subjectivity from its constitutive position." That sentence appears nowhere in the volume raw: "terminological" occurs exactly twice in the whole volume (l. 1392, "terminological horizon" about the Earth as soil/stem; l. 2771, "terminological choices" about il y a / Wesen / flesh), and "constitutive position" / "displaces transcendental" occur zero times. The quoted string is verbatim the extraction note's own Pass-2a paraphrase (l. 262, the Claim field of Ch 4 argument 3) — promoted into the register as if it were Mendoza-Canales's wording, with an embedded sub-quote ("materialist ontology") that makes the outer text read as authorial. This is the General Rule 16 quotation-inflation pattern: a maintainer paraphrase upgraded to a source quotation. (b) Rule 18 local context of the one real quotation. The volume's single occurrence of "materialist ontology" is raw 1606: "They mark not merely a reform of phenomenology but its transformation into a materialist ontology." The grammatical subject "They" is the set of late-ontology notions named in the preceding sentence — "hyper-dialectics," écart, "brute" or "wild Being" — which the same sentence says "were elaborated after the course on institution," the institution course being only their seedbed. M-C's predicate attaches to the V&I-era vocabulary, not to the Stiftung→institution rendering; the evidence bullet re-attached it to a different subject. (c) Locator mismatch, and the real coinage passage supports the rival. The coinage is at raw 1812, two sections later, in §3 "Becoming Institution" — and read in its actual local context it states the opposite valence to the claim's headline: "By extending the dynamics of institution from the classical Stiftung–Foundation to a Stiftung–Becoming relation, Merleau-Ponty introduces a differential element into the process" — an extension of Stiftung, not a break with it. The tail of the cited range says the same: raw 1656–1658, "Stiftung … points in two directions … It is precisely this second orientation that Merleau-Ponty will draw out and radicalize in his own concept of institution, transforming the Husserlian framework from within … Merleau-Ponty retains the genetic emphasis of Stiftung but reworks its logic." Consequence for the promotion. With bullet 3 re-anchored, the "constitution → institution" half of the claim remains well anchored (Popa raw 546–550; Pagan raw 877; León raw 3879 — all verified verbatim). But the "not a development of Husserl's Stiftung" half then rests on a single sentence, León raw 3879, which as written concedes rather than denies the development reading: "it would be problematic not to see in the notion of institution more than a development of the Husserlian notion of Stiftung." "More than a development" is compatible with "a development and a paradigm shift"; it does not license "best read not as a development … but as a paradigm shift" (Claim field) or "not internal development of Husserlian Stiftung" (Title). Test 2 is therefore not met for the corrective half of a genealogical/corrective claim. Hold at live until the "more than a development" wording of raw 3879 is reconciled with the claim's "not a development" headline.
  • C3 supported-jury refuter objection (rival-reading lens, consolidation 2026-07-27 run 5, wf_a0b34b6a-bc5): Undefeated rival reading: the "constituting subject" MP opposes in the 1954–55 course is the contractualist/idealist philosophy of consciousness (Brunschvicg's reflective idealism and Sartre's Sinngebung), not Husserl's Stiftung-thinking — on which reading institution is a radicalization within Husserlian genetic phenomenology, i.e. exactly the "development" this claim denies. (i) The claim's two load-bearing MP passages both carry local qualifiers that restrict the opposition away from Husserl. At I&P 8 (raw I&P l. 496) the sentence reads "To constitute in this sense is nearly the opposite of to institute" — and "this sense" is fixed by the two preceding sentences, which describe consciousness on the contract model. MP's own marginal gloss on that very sentence (note 12, raw 1610) makes the register explicit and non-Husserlian: "Juridical opposition of the notions of contract and institution." The Claim field's "almost opposites — not gradations but near-antagonists" is further cut against by MP's next sentence in the same paragraph (raw 496): "Constitution [means] continuous institution, i.e., never done" — constitution written as a mode of institution, a differential inside one genus, not a paradigm displaced by another. (ii) At the very passage where MP defines institution, his operative term for the instituted's productivity is Husserl's. Raw 506: "The instituted will change but this very change is called for by its Stiftung." And in the course's Husserl section (raw 1284) MP performs the analysis in Husserl's own vocabulary — "Every institution involves this double aspect, end and beginning, Endstiftung at the same time as Urstiftung" — and credits Husserl with the displacement bullet 3 attributed to MP against Husserl: "[For] Husserl, finally, the transcendental origin cannot be anything other than the empirical origin" (raw 1288). Margin note 24 (raw 1636): MP endorses Husserlian reactivation ("Husserl rediscovers here one of the senses of Permanent Revolution"), uses gestiftet affirmatively, and names Sartre's "abrupt Sinngebung" as the thesis to be discussed. (iii) MP explicitly separates Husserl from the "philosophy of consciousness." Raw 1238: "distinguish the conclusions that Husserl comes to from those that Brunschvicg comes to." The editors gloss MP's philosophy-of-consciousness marker as "cf. Brunschvicg" (note 34, raw 4017). At I&P 76 (raw 1554) Husserl enters the criticized paragraph only as a concession — "Even if we grant that certain of the objects are 'never completely' constituted (Husserl)" — not as the position's holder. The register already carries this identification: claims#non-philosophie-as-empietement-of-refused-world (live) makes Brunschvicg's immanence philosophique MP's standing negative referent. The Claim field's gloss of the target as "Husserlian-Cartesian, transcendental ego" is a substitution the primary text does not license. (iv) The entry's own coordinate supported claim states the rival — claims#ip-pop-architectural-hierarchy (supported) holds that "Stiftung … supplies the temporal grammar" and the late work "presupposes the earlier rather than supersedes"; Counterpressure bullet 2 registers the tension and then simply asserts the reconciliation without argument. (v) The "four-chapter convergence" is not four independent tests — the extraction note records the same MP passage grounding three chapters "with structurally identical interpretive use" (l. 1497) and flags the paradigm-shift reading's "Friction" with the wiki's institution–Stiftung page (l. 1151); Evidence bullet 2 concedes Pagan's instituting subject is "first a reply to Sartre" — the rival's chronology. Counterpressure bullet 1 names only a secondary-literature version of the continuity rival (Caminada, who reaches the wiki only through León's dismissal, not in his own voice). (vi) The entry's own supported bar is unmet (non-M-C corroboration; reconciliation with the synthesis reading, still candidate). Until the entry states and defeats the Brunschvicg/Sartre-target reading on MP's own text — minimally the "in this sense" restriction, margin note 12, "Constitution [means] continuous institution," the affirmative Urstiftung/Endstiftung analysis at raw 1284, and raw 1238's Husserl-vs-Brunschvicg separation — the claim stays at live.

Payoff

The claim sharpens the wiki's institution page architecture: institution is not a subset or development of Stiftung but a near-antagonist of constitution. This re-grounds claims#ineinander-universalizes-institution (supported; label refreshed 2026-07-27) — the Ineinander universalization of institution is intelligible as ontological generalization of the instituting-subject paradigm, not as Husserlian Stiftung extended to flesh. It also sharpens what claims#kaushik-stiftung-literary-frame (supported; label refreshed 2026-07-27) leaves under-developed: Kaushik's symbolic-matrix reading subsumes institution under Husserlian-rhetorical apparatus, but the paradigm-shift reading positions institution as that which the literary-rhetorical apparatus is itself a regional case of. Coordinate with claims#mp-painter-as-primary-witness-for-indirect-ontology (supported; label refreshed 2026-07-27): the painter is primary-witness because painting enacts what the instituting-subject paradigm means — the body, the seen, and the made-canvas are co-present in a single act with no constituting-ego mediation.
